How do Our Trademark Services Work?

Here is how we help you register and protect your trademark:

  1. Analyze your choices: Our lawyers will assess whether a trademark application is feasible and determine which of your assets can be trademarked.
  2. Clearance search: By thoroughly examining the Trademark Electronic Search System, our lawyer will verify availability across federal, state, and common law trademark to discard the existence of similar trademarks that could cause the denial of your application.
  3. Prepare the application: We do the required paperwork and file the trademark application in the United States and internationally, according to your objectives. We will keep track of the process and be in constant communication with you while you focus on your business. We will also respond to non-substantive actions that may impede the registration.
  4. Registration: Once your application is approved without opposition, your registration will be complete. We will send you your Trademark Registration Service and explain to you how you can protect your trademark and maximize your profit.
  5. Licensing Agreements: If someone wants to be authorized to use your trademark, we will arrange any licensing or asset purchase agreement to get the most value from your brand.

Trademark and Copyright FAQ

A trademark is anything that distinguishes your brand’s products and services. Almost anything that identifies your brand can be trademarked, including:

  • Company name
  • Logo
  • Product name
  • Product shapes and packaging designs
  • Slogan or catchphrase
  • Symbol
  • Design
  • Typeface
  • Color or color scheme
  • Jingle
  • Sound
  • Characters
  • YouTube Channel Names

Your trademark lasts as long as you are using the mark in commerce. Since trademark rights are acquired through use, you have to keep using them to maintain your trademark rights.

The approval process may take a few months (six or more) and depends on the United States Patent and Trademark Office’s (USPTO) load. However, your trademark protection starts when you file your application.

No. The USPTO filing fees are not refundable, even when your application is rejected. However, part of our firm’s process is to do a risk analysis before filing.

Filing your LLC only protects your business name from being used by other companies in the state of registration. However, registering your trademark will protect it nationwide and discourage competitors from using the name or similar-sounding names. Registering your trademark allows you to sue someone using your name, whereas the LLC name overlap does not give you that right.

If you register your trademark application yourself, you risk your application being rejected, incorrectly filing the application which may result in the wrong protections, delaying the process and wasting money, and you will need to stand up for yourself in the case of an infringement issue against you.
