The approval process may take a few months (six or more) and depends on the United States Patent and Trademark Office’s (USPTO) load. However, your trademark protection starts when you file your application.

No. The USPTO filing fees are not refundable, even when your application is rejected. However, part of our firm’s process is to do a risk analysis before filing.

Filing your LLC only protects your business name from being used by other companies in the state of registration. However, registering your trademark will protect it nationwide and discourage competitors from using the name or similar-sounding names. Registering your trademark allows you to sue someone using your name, whereas the LLC name overlap does not give you that right.
